1. Share Eco-Value Securely on RentMy1

1.1 RentMy1 operates an online portal allowing:
(a) Users advertise items for rent (such Users are "Lenders");
(b) Lenders to interact and enter into rental agreements with other Users to rent such items (Users that rent are "Renters");
(c) Users who are Lenders can also be Renters and vice versa:
(d) Using RentMy1's online portal Renters pay Lenders for renting the relevant items; and
(e) Users, both Lenders and Renters, can resolve disputes concerning the rental items.
These services are made available to you through the RentMy1 Application available for download on your mobile device (the "RentMy1 App") and our website at https://rentmy1.com(together, the "RentMy1 Service").
1.2 The RentMy1 Service is provided by RentMy1 (the following terms are interchangeable and have the same meaning "RentMy1", "it", "our", or "us").

2. RentMy1 Details

2.1 RentMy1 is an entity registered in Ireland, with its registered address at Strand House, Strand Road, Sutton, Dublin, 13, Ireland.

3. The RentMy1 Service

3.1 RentMy1's Service allows Lenders to advertise items for rent,  interact  and enter into agreements with Renters for the rental of those items.

3.2 The RentMy1 Service may make available social features, which enable Users to message and share information about their use of the RentMy1 Service with other Users. Use of these features must comply with RentMy1's Rules of Acceptable Use, as set out below.

4. User's Information

4.1 User's privacy is important. Users are requested to read RentMy1's Privacy Policy (https://RentMy1.com/privacy-policy) to understand how information about Users is collected, used and/or shared.

5. Users of the RentMy1 Service

5.1 This and any documents referred to within it (collectively, the "Terms of Use") set out the terms of the User's Relationship with RentMy1. Users must read and understand these Terms of Use before using the RentMy1 Service.

5.2 By accessing and using the RentMy1 Service, the User agrees to these Terms of Use. Users who do not agree to these Terms of Use, are kindly requested not to access, or use, the RentMy1 Service

5.3 Additional terms can apply to the User depending on whether the User is either Lender or Renter in a transaction using the RentMy1 Service. Lenders should refer to Clause 16 and Renters to Clause 17.

6. Setting up the User's Account

6.1 You must be 16 years or older and able in your country of residence to enter into a legally binding agreement to use the RentMy1 Service. If you are under the age of 18 a parent, or guardian, signature may be needed to enter into this agreement on your behalf. RentMy1 will hold a legally binding agreement with the parent, or guardian in such cases.

6.2 To access the RentMy1 Service, Users must set up an account using their email address (User's "Account"). Users will create a password for their Account – the use of strong passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) is recommended.

6.3 The sole responsibility for maintaining the confidentiality of login details and for any activities that occur under the User's Account remains with the User. If a User think their Account may have been misused, the User should contact and inform RentMy1 at info@rentmy1.com immediately.

7. User's Right to Use the RentMy1 Service

7.1 The RentMy1 Service is personal to the User and cannot be given to any other person  or entity. The right given to a User to use the RentMy1 Service does not under any circumstances prevent RentMy1 from giving others the right to use the RentMy1 Service.

7.2 Save where allowed by these Terms of Use, or as permitted by the operating of the RentMy1 Service, the User agrees:

(a) not to change, or attempt to change the RentMy1 App or any other element of the RentMy1 Service in any way or to seek, or access, the code of the RentMy1 App or any other element of the RentMy1 Service that has not been expressly published publicly for general use by RentMy1.

(b) not to give or sell or otherwise make available the RentMy1 App or any other portion of the RentMy1 Service to anybody else or to copy, or attempt to copy the RentMy1 App or any other portion of the RentMy1 Service;

7.3 The materials and content comprising the RentMy1 Service belong to RentMy1, or its 3rd party licensors, permission to use these materials and content is given solely for the purpose of using the RentMy1 Service in accordance with these Terms of Use.

7.4 Users agree that they have no rights in, or to, the RentMy1 App, or any other portion of the RentMy1 Service, other than the right to use and access them in accordance with these Terms of Use.  Users also that all confidential information, copyright and other intellectual property rights in the RentMy1 App or any other element of the RentMy1 Service belong to RentMy1 and/or the people or entity who have licensed those rights to RentMy1.

8. RentMy1's Liability/Responsibility to the User

8.1  Due to the nature of the service the RentMy1 App, and any other portion of the RentMy1 Service, may contain some content owned, or developed, by third parties. Reasonable endeavours are made by RentMy1  to ensure that the RentMy1 App and the RentMy1 Service are of a reasonable standard and quality and match any descriptions provided to Users. As RentMy1 does not own or produce such third party content, RentMy1 cannot be held responsible for it in any way.

8.2 In the event of a claim arising out of the provision of the RentMy1 Service, all, and any, responsibility to the User will never be more than the amount paid by the User to RentMy1 in the 12 months prior to the claim arising and, in the event that no payment has been made by the User RentMy1 denies any responsibility to the User whatsoever.

8.3 The internet and technology currently available mean regrettably the RentMy1 Service can only be provided on an "as available" and "as is" basis. RentMy1 cannot therefore provide an assurance that the rentMy1 Service will no have interruptions, delays, be error free or meet Users exacting expectations and hence no commitment can be given on the performance or availability of the RentMy1 Service in these terms of Use.  To the extent possible due to the nature of the limitations to the Services as described, RentMy1 also excludes any commitments implied by law. 

8.4 RentMy1 will never be responsible for any loss or damage that is not reasonably foreseeable in all and/or any case. although this does not affect the User's rights under the applicable law of the User's country of residence including responsibility caused by RentMy1's negligence.

9. Termination of the User Relationship

9.1 The User must immediately stop using the RentMy1 Service in the event that the User does not feel that the User can agree to these Terms of Use, or any changes made to either these Terms of Use or the RentMy1 Service.

9.2 Use of the RentMy1 Service may be immediately terminated by RentMy1 if the User breaks the Rules of Acceptable Use, any other important rule(s), or terms and conditions set by RentMy1 for accessing and using the RentMy1 Service including these Terms of Use.

9.3 Deleting the RentMy1 App might not close any Account the User has created in relation to the RentMy1 Service. In the event that the User wishes to close their Account for the reason that deleting the RentMy1 App might not close any Account the User has created in relation to the RentMy1 Service the User must notify RentMy1 by contacting RentMy1 using the details and functionality at https://rentmy1.com/contact-us, and RentMy1 will ensure that the User's use of the RentMy1 Service is terminated.

9.4 In the event as described in this section the User or RentMy1 terminates use of the RentMy1 Service or RentMy1 withdraws Service, RentMy1 reserves the right to delete the User's Content, any other information the User has uploaded to the RentMy1 Service or which RentMy1 holds about the User.  The User will also lose any rights to use the RentMy1 Service or to access RentMy1's content and/or the User's Content.  No compensation will be offered to the User, or Users, for any losses suffered if the User, or Users, right to access and use the RentMy1 Service or any such information, content or User Content is terminated.  RentMy1 recommends that Users should keep copies of any information or content used on the RentMy1 Service as well as the User Content.

9.5 Termination of the User's use of the RentMy1 Service and cancellation of the User's Account shall not affect any of the User's obligations to pay any sums due to RentMy1. RentMy1 reserves the right to withdraw any part of the Remy1 Services at any time; User's will be notified if RentMy1 considers that User's use of the RentMy1 Service will be materially impacted.  No legal rights the User may have under the law of the country in which the User resides are affected by anything in this section.

10. Acceptable Use

10.1 As well as the other requirements within these Terms of Use, this section describes specific rules that apply to Users when using the RentMy1 Service (the "Rules of Acceptable Use").

10.2 Using the RentMy1 Service the User is not entitled to:

(a) circumvent, disable or otherwise interfere with any security related features of the RentMy1 Service and if suspended or banned from using the RentMy1 Service by RentMy1, the User must refrain from so doing;

(b) give any false or misleading information, impersonate any person or permit any other person to use the RentMy1 Service under the User's name or on the User's behalf unless such person is authorised by the User;

(c) advocate, promote or engage in any illegal or unlawful conduct or conduct that causes theft, loss, damage or injury to any person or property or promote or advertise any goods or services, other than items the User, as a Lender, makes available for rent through the RentMy1 Service;

(d) send any unsolicited marketing communications through the RentMy1 Service or modify, disrupt, intercept, interfere with or hack the RentMy1 Service or misuse the RentMy1 Service by knowingly introducing Trojans, logic bombs, viruses, worms or other deleterious material which would harm any of the RentMy1 Service, or the equipment of any User of the RentMy1 Service;

(e) use any automated system, including without limitation "robots", "spiders" or "offline readers" to access the RentMy1 Service in a manner that send more request messages to the RentMy1 Service than a human can reasonably produce in the same period of time;

(f) submit or contribute any User Content that contains nudity or violence or is abusive, threatening, obscene, misleading, untrue or offensive or collect any data from the RentMy1 Service other than in compliance with these Terms of Use;

(g) submit or contribute any User Content that the User does not own or have the right to use or otherwise infringe the copyright, trademark or other rights of third parties or use any User Content which involves violating any licensing terms specified by the Content owner;

(h) other than leaving reviews about Lenders, Renters or items, submit or contribute any information or commentary about any other person without that person's express permission;

(i) threaten, abuse, or invade, another's privacy, or cause annoyance, inconvenience or needless anxiety or be likely to harass, upset, embarrass, alarm or annoy any other person (including, but not limited to, other Users, and RentMy1 employees);

(j) enter into any agreement to lend or rent any item other than through the RentMy1 platform with any other User who the User initially met through the RentMy1 Service. For each instance of doing this which is defined as “Fee Avoidance” and the User will be liable for double the fees avoided, or a €250 Additional Fee (whichever is greater).

10.3 Non-compliance with the Rules of Acceptable Use represents an extremely serious breach of these Terms of Use, and RentMy1 reserves the right to take all, or any, of the following actions (with, or without, notice):

(a) immediate, temporary or permanent withdrawal of the User's right to use the RentMy1 App, or any other portion of the RentMy1 Service and removal of any User Content;

(c) issuing of a warning to the User and/or legal action against the User including proceedings for reimbursement for costs (including, but not limited to, all reasonable legal and administrative costs) resulting from the non-compliance; 

(d) disclosure of such information to law enforcement authorities as RentMy1 reasonably considers appropriate.

10.4 Please note that the actions described in paragraph 10.3 are not limited, and RentMy1 reserves the right to take any other action that it considers appropriate in the circumstances.

11. User Content

11.1 The User must confirm that any images, text or information that the User uploads to the RentMy1 Service, including any reviews that posted about other Users or items (collectively, "User's Content") will meet the rules of Acceptable Use.

11.2 RentMy1 does not claim ownership of  User's Content, and ownership will remain with the User and any third party whose content is included in the User's Content. The User instead grants RentMy1 a worldwide, royalty-free, non-exclusive, and perpetual license to use, copy, distribute, re-format, modify, adapt, sub-license and otherwise make available the User Content anywhere and in any form for the purposes of providing the RentMy1 Service (including allowing Users to whom the User gives access, to view, and use, your User Content).

11.3 It is the User's responsibility to ensure that the User is able to grant RentMy1 the above license for any content owned by a third party that the User includes in their User Content.

11.4 The User's rights to privacy are not in any way affected by RentMy1's right to use the User's Content . Please see the RentMy1 Privacy Policy (https://rentmy1.com/privacy-policy) where information is provided on the way RentMy1 will use User's personal information. The right to monitor any User Content is reserved by RentMy1 as is the right to reject, delete or refuse any User Content which in the consideration of RentMy1 breaks any of the rules of Acceptable Use.

12. Notice and Takedown policy

12.1 If any person considers any content available through the RentMy1 Service infringes their rights they may contact RentMy1 by sending a notice (an "Infringement Notice") to RentMy1.  This Infringement Notice should be sent by email to copyright@rentmy1.com. The Infringement Notice should provide the following information:

(a) the person's name and contact details;

(b) the person should provide a statement explaining in sufficient detail why the person considers that the content available through the RentMy1 Service infringes the person's rights, or fails to comply with RentMy1's Rules of Acceptable Use; and a link to, or such other means of, identifying the objectionable material.

12.2 Depending on the nature of the Infringement Notice RentMy1 will take what is considered to be the appropriate action and will respond to the person raising the Infringement Notice describing the action RentMy1 proposes to take within a commensurate time frame. 

13. User's Relationship with RentMy1

13.1 The current version of these terms of Use contains the only terms and conditions that apply to Rentmy1's User relationship. RentMy1 avers that these Terms of Use as written set out the terms of the agreement with the User for the provision of the RentMy1 Service. In the event that for whatever reason part of these Terms of Use cannot be enforced then the remainder of these Terms of Use will still apply to this agreement.

13.2  If for whatever reason RentMy1 does not take immediate action when the User does not comply with these Terms of Use this should not, under any circumstances, be taken as implying that RentMy1 has waived any of its rights, and RentMy1 reserves its right to take all, and any, appropriate action in the future.

14. Contact, Feedback and Complaints

14.1 In the event that the User needs to contact RentMy1 in relation to these Terms of Use or any other document mentioned in them, please email us at info@rentmy1.com .

14.2 RentMy1 is always delighted to hear from our Users and is always interested in learning about how the RentMy1 Service can improve. By providing feedback a User agrees to give up any rights the User has in/to that feedback so that RentMy1 may use and allow others to use it without any restriction and without any payment being due to the User who has provided the feedback.

Landers and Renters

15. Sharing Eco-Value Securely 

15.1 RentMy1 provides only the portal that allows Users to rent and lend items, but is not a Renter or Lender itself.  The quality of the items made available for rent by Lenders through the RentMy1 Service is not regularly monitored by RentMy1.

15.2 The Lender in a rental transaction will be responsible for complying with any obligations under applicable law with respect to the items that the Lender provides for rent, including giving effect to Renters' rights under applicable consumer law and compensating any damage to the Renter, or any other person, caused by the rented items.

15.3 The Lender and not RentMy1 is responsible for ensuring conformance of items to descriptions provided, and that the items are fit for purpose and safe to use. We will not be responsible to the Renter, for any items that are rented rent through the RentMy1 Service.

15.4 The Renter in a rental transaction will be responsible for any items rented through the RentMy1 Service, including the need to compensate the Lender for any loss or damage to those items. The Renter will also carry the responsibility for any damage  caused to other people and/or property, when using those items.

16. Terms for Lenders

16.1 This Section only applies to Lenders.

16.2 Lenders must not offer to lend through the RentMy1 Service any firearms, weapons, pornography, mature content, animals or any items that it would be illegal to offer for rent in the Lender's and/or the Renter's country of residence. RentMy1 may remove any such items offered for rent from the RentMy1 Service if it believes such items are illegal, immoral or damaging to RentMy1's reputation.

16.3 The Lender will be responsible for any damage the Renter or any other person may suffer as a result of any defect in the item rented from the Lender, or for all, and any, failure to comply with the requirements of these Terms of Use.

16.4 Lenders must ensure that:

(a) Any items rented to the Renter are delivered in accordance with the agreement reached with the Renter and that Lenders have all the necessary rights necessary to rent out any items Lenders advertise on the RentMy1 Service and belong to the Lender, and that no other Party's rights will be infringed by the Renter's use of those items;

(b) All, and any, descriptions of the items advertised for rent through the RentMy1 Service are accurate and include all information relevant to the item's use. These include (as required): (i) notice of any defects, restrictions or other requirements that may apply to the use of the item; and (ii) all, and any, licenses, instructions, or notices that may be legally and/or reasonably required to use the item safely;

(c) Items advertised on the RentMy1 Service: (i) conform in all, and any, material respects to any pictures or descriptions uploaded to the RentMy1 Service; (ii) are safe to use in accordance with all, and any, reasonable instructions you provide to the renter; (iii) are fit for any purpose for which such items would normally be used, or any purpose communicated to the Lender by the Renter; (iv) can be legally offered for rent.

16.4 If, for instance, storage space or a similar item is offered for rent, the Lender is responsible for ensuring that the space is accessible safely and legally, that it is secure and suitable for the purpose for which it is intended. The responsibility for any damage to all, and any, of the items that are left in the Lender's storage area is the Lender's.

16.5 Lender's are free to agree any other terms on which an item is rented to a Renter, including the price for renting the item for the relevant rental period (the "Rental Fee"). When items are posted for rent on the RentMy1 Service, the Rental Fee advertised by the Lender on the listing must be the total price payable for renting the items, including any applicable taxes or costs of delivery.

16.6 When the terms are agreed for renting an item to a Renter, those terms must not be amended by the Lender (including the price) unless there is a valid, justifiable reason for doing so and the Renter agrees to the amended terms.

16.7 A Lender can remove a listing or cancel the agreement to rent an item to a Renter at any time up to 48 hours before the start of the relevant rental period. If the Lender cancels an agreement to rent an item to a Renter less than 48 hours before the start of the rental period, the Lender may be charged a cancellation fee equal to 20% of the relevant Rental Fee.

17. Terms for Renters

17.1 This Section only applies to Renters.

17.2 When a Renter agrees to rent an item from a Lender, the Lender grants the Renter a limited right to use that item for the relevant rental period. This limited right is personal to the Renter and is non-transferable to any other person.

17.3 The Renter bears the responsibility for ensuring that:

(a) Any item rented through the RentMy1 Service can be legally used and that compliance with any and all applicable laws when the item is used;

(b) All, and any, reasonable directions provided by the Lender in order to use the item safely are complied with;

(c) The item is returned to the Lender in the same condition as it was in when it was collected (any reasonable wear and tear not included).

17.4 If the Renter rents storage space or similar item through the RentMy1 Service the Renter must ensure that the items stored are not flammable, dangerous or hazardous to people or animals, and do not exceed €15,000 in value. Any damage caused to the storage space, the Lender or any other person and/or property, as a result of the Renter's use of any such space rented through the RentMy1 Service will be the Renter's responsibility.

17.5 A request to rent an item can be cancelled at any time before the request is accepted by the Lender, or at any time up to 48 hours after the request is submitted, this period is known as the "cooling off" period. If the rental request is made within 48 hours of the start date, there is no cooling off period. By cancelling before the request has been accepted, or within the cooling off period, the Renter will receive a full refund.

17.6 The return of any items rented to the Lender can be agreed between the Renter and Lender; however, it is the responsibility of the Renter to ensure that any items rented must be returned to the lender before the end of the rental period.

17.7 Any loss of, or damage to, the item rented will be the responsibility of the Renter. RentMy1 recommends the Renter study Clause 19 for more information about how disputes between Renters and Lenders are handled, including if the item is damaged, lost, or stolen.

17.8 In the event of failure to return an item at the end of the agreed rental period the Renter must contact the Lender and RentMy1 to notify both, as soon it is clear that the item is not going to be returned by the end of the agreed rental period. If possible, the Renter must book and pay for any extended time without any delay. If the Lender is unable to facilitate the requested extension it is the Renter's responsibility to return the item(s) back to the Lender within the Lender's schedule. The Renter will be liable to pay late fees if the item(s) are not returned to the Lender within the Lender's schedule.  These late fees will be double the rental fee for the period the item was late (“Late Fees”).  By using the RentMy1 Service the Renter has agreed that RentMy1 can charge this amount from the Renter's card or bank account without further permission.

17.9 In the event that the Renter misses the end of the agreed rental period for return of the item and does not communicate with both the Lender and RentMy1, or there are reasons to believe the Renter has caused damage to the item, by using the RentMy1 Service the Renter agrees that RentMy1 can take a holding deposit from your account up to the full value of the items you have rented (“Holding Deposit”). Such a deposit will be fully refundable, less any fees owed to RentMy1 or Lender, once the items are returned, replaced or repaired. If the item(s) are not returned, replaced or repaired the deposit will not be refunded.

18. Fees and Payment

18.1 The User, when creating an account, will need to provide RentMy1 with valid, up-to-date and complete credit, or debit card, details. When a rental transaction is agreed, the User authorises RentMy1 to charge such credit, or debit card, for the relevant Lender Fee and/or Renter Fee and in creating the account the User thereby confirms that the details provided are accurate and that the User has the right to use the payment method selected.

18.2 RentMy1 will collect the Rental Fee from the Renter on the Lender's behalf. Except in circumstances where RentMy1 is unable to obtain payment from the Renter, such as where a Renter's payment method is refused or our payment services provider determines that there is a risk of fraud, RentMy1 will transfer the Rental Fee to the Lender within 24 hours of the start date of the rental. RentMy1 will also charge the Lender a fee of 15% of the Rental Fee ("Lender Fee"), which will be deducted from the amount the Lender receives.

18.3 When the Renter has agreed to rent an item the Lender, RentMy1 will charge the Renter the full Rental Fee on the Lender's behalf. RentMy1 will also charge the Renter an additional fee for the use of the RentMy1 Service which will be 15% of the rental amount the Renter pays to the Lender ("Renter Fee").

18.4 In the event that RentMy1 is not successful in charging the Rental Fee, Renter Fee, Late Fee, Settlement Fee or any other amount to the User's credit or debit card, and, after informing the User, has not received payment within 7 days, RentMy1 is within its rights to suspend or temporarily disable all, or part, of the User's access to the RentMy1 Service (without any responsibility to the User), and RentMy1 shall be under no obligation to provide any, or all, of the RentMy1 Service while the amount concerned remains unpaid. This will not affect any other rights and remedies available to RentMy1 or the Lender. In the event that the User charges back a payment that the User is under obligation to make under the terms of this agreement, the User's account will be immediately suspended until the payment is re-paid, or the chargeback is cancelled.

Solutions to Issues

19. Between Lenders and Renters

19.1 Users are encouraged by RentMy1 to resolve any disputes directly. In the event that the Renter has lost or damaged an item, the Renter bears the responsibility for the immediate reimbursement of the Lender of the full value of (where possible) repairing the item or replacing it.

19.2 In such an event RentMy1 may ask the Lender to provide proof of purchase, photographs of any damage caused to an item, and/or any other evidence to support a claim for reimbursement from a Renter. RentMy1 may also ask the Lender to provide photographs and (where the item is operational equipment) a video of it operating showing the item lost or damaged taken before it was rented to the Renter.  This is to support the Lender's claim that any damage was indeed caused by the Renter and was not present at the commencement of the rental period and this will also support consideration of the condition of the item at the commencement of the rental period. Such photographs or videos should be timestamped, or taken by a Smartphone which will provide evidence of the time and date of their taking.

19.3 RentMy1, in circumstances where a Lender and a Renter are unable to resolve a dispute between them directly, can be asked to act as moderator to resolve the dispute. In the event that RentMy1 is called upon to act as moderator to resolve  a dispute between the Lender and Renter directly,RentMy1 may charge a fee of up to 30% of any amounts that RentMy1, the Lender and the Renter assess are payable by the Renter to compensate the Lender for any loss or damage to the item. RentMy1 will charge this amount from the Renter in addition to any amounts the Renter is required to pay to the Lender (altogether known as the “Resolution Fee”). In the event that RentMy1 is called upon to moderate the dispute it is a requirement of the use of these Terms of Use that Users must agree to accept RentMy1’s conclusion.  In such an event the User must pay any amount for which RentMy1 determines the User is liable.

19.4  As part of these Terms of Use the User must agree to pay any amount to RentMy1, or to another user, owed through use of the RentMy1 Service promptly and not more than 48 hours from it being requested.  RentMy1 may debit this amount from the User's card if this money is not paid by the User within this period.  The User agrees to allow RentMy1 to do this by using the RentMy1 Service and agreeing to RentMy1's Terms of Use.  The User also agrees to waive all, and any, right to chargeback this transaction through a bank or other means.

20. Lender Guarantee

20.1 In the event that a Lender is unable to recover the cost of repairing or replacing an item or the estimated value of the item, RentMy1 may reimburse the Lender any such amounts provided the Lender meets the criteria laid out in the "Lender Guarantee", which can be read in full at https://s3-eu-west-1.amazonaws.com/rentmy1--assets/lender-item-guarantee.pdf . Further details of the Lender Guarantee are also available at https://rentmy1.com/guarantee .

20.2 In the event that RentMy1 agrees to reimburse the Lender under the Lender Guarantee, the Lender is required to inform the Renter that any, and all, amounts owed to the Lender which RentMy1 has reimbursed will now be owed to RentMy1. Any payment made by RentMy1 to the Lender under the Lender Guarantee will not affect the Renter's obligation to pay for the items that have been lost, stolen or damaged.  This obligation will now however be owed to RentMy1 rather than to the Lender.

21. With RentMy1

21.1 In the event that the User has an issue with RentMy1 relating to the RentMy1 Service, in the first instance the User should contact RentMy1 at info@rentmy1.com and a concerted attempt will be made to solve the problem informally. In the unlikely event that this problem cannot be solved informally then RentMy1 will consult and agree the most effective way of finding a mutually agreeable solution. 

22. With Apple App Store Provisions

22.1 Where the RentMy1 App has been downloaded from the Apple App Store this paragraph applies. The User agrees and acknowledges that these Terms of Use are solely between the User and RentMy1, not Apple, Inc. ("Apple") and that Apple has no responsibility for the RentMy1 App, or content thereof. Use of the RentMy1 App must comply with the App Store Terms of Service.

22.2 The User acknowledges that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the RentMy1 App. In the event of any failure of the RentMy1 App to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price for the RentMy1 App to the User; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the RentMy1 App, and any other claims, damages, costs, losses, liabilities or expenses attributable to any failure to conform to any warranty will be solely governed by these Terms of Use and any law applicable to RentMy1 as provider of the RentMy1 App.

22.3 The User acknowledges that Apple is not responsible for addressing any claims of the User or any third party relating to the RentMy1 App or the User's possession and/or use of the RentMy1 App, including, but not limited to: (a) product liability claims; (b) any claim that the RentMy1 App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation; and all such claims are governed solely by these Terms of Use and any law applicable to RentMy1 as provider of the software.

22.4 The User acknowledges that, in the event of any third party claim that the RentMy1 App or  possession and use of that RentMy1 App infringes that third party’s intellectual property rights, RentMy1, not Apple, will be solely responsible for the investigation, defence, discharge and settlement of any such intellectual property infringement claim to the extent required by these Terms of Use.

22.5 The User represents and warrants that (a) the User is not located in a country that is subject to U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) the User is not listed on any U.S. Government list of prohibited or restricted parties.

22.6 The User and RentMy1 acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Use as relates to the User license of the RentMy1 App, and that, upon the User's acceptance of the terms and conditions in these Terms of Use, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use as relates to the User's license of the RentMy1 App against the User as a third-party beneficiary thereof.

23. With App Marketplaces and Platforms

23.1  Where the RentMy1 App has been downloaded from any app store or distribution platform other than the Apple App Store, including the Google Play Store (the "Distribution Platform ") this paragraph applies:

(a) The User acknowledges that these Terms of Use are between the User and RentMy1, and not with the provider of the Distribution Platform ("Store Provider");

(b) Use by the User of the RentMy1 App must comply with the Store Provider’s then-current Distribution Platform Terms of Service;

(c) As the Store Provider is only a provider of the Distribution Platform where the User obtained the RentMy1 App RentMy1, and not the Store Provider, is solely responsible for the RentMy1 App;

(d) the Store Provider has no obligation or liability to the User with respect to the RentMy1 App or these Terms of Use; and the User acknowledges and agrees that the Store Provider is a third party beneficiary to these Terms of Use as it relates to the RentMy1 App.

Changes and Law

24. The RentMy1 Service

24.1 The RentMy1 Service is constantly being updated and improved to seek new ways to provide Users with innovative features and services and take account of changing technologies, tastes, behaviour and use of the internet and the RentMy1 Service.

24.2 Due to this RentMy1 may need to update, reset, stop offering and/or supporting a particular part of the RentMy1 Service, or feature relating to the RentMy1 Service ("changes to the RentMy1 Service"). These changes to the RentMy1 Service may affect User's past activities on the RentMy1 Service, features that are used, User Content and any other information submitted to the RentMy1 Service ("Service Features"). All and any changes to the RentMy1 Service carry the risk that your Service Features may be deleted or reset.

24.3 Users must agree and accept that a crucial element of the RentMy1 Service is that changes to the RentMy1 Service will take place over time.  This is an important tenet on which Users are granted access to the RentMy1 Service. Users continued use of the RentMy1 Service will be taken as acquiescence that they have accepted any changes to the RentMy1 Service. It is always the User's prerogative to stop using the RentMy1 Service.

25. Documents

25.1 These Terms of Use may occasionally be revised however the most current version will always be that which is available at https://rentmy1.com/terms-of-service or in the relevant section of the RentMy1 App.  The addition of new facets to the RentMy1 Service will be the commonest reason for changes, or indeed changes in the law, or where RentMy1 feels it necessary need to clarify its position on a particular matter.

25.2 Urgent changes may, on occasion, need to be made immediately and under these circumstances RentMy1 will not be able to give Users any notice.  Normally however RentMy1 will endeavour to alert Users prior to new Terms of Use coming into operation.

26. Applicable Law

26.1 Irish law will apply to all disputes and the interpretation of these Terms of Use. If RentMy1 needs to apply to court to enforce any part of these Terms of Use against a User or resolve any other dispute between RentMy1 and a User arising from, or related to, use of the RentMy1 Service, RentMy1 will initially seek to apply to the Irish courts. A User's rights under the law of the country in which the User resides are unaffected, including the right to have a dispute in relation to the use of the RentMy1 Service heard in the courts of that country.
